Section 1. Scope and Purpose
This Policy explains how Chozi collects, uses, stores, processes, shares, and protects information in connection with your access to and use of the Chozi platform, including its websites, applications, tools, features, and related services (collectively, the "Platform"). This Policy applies to all users of the Platform, including buyers, tenants, property owners, agents, agencies, developers, and organizations that use Chozi through individual, team, or enterprise accounts. It applies regardless of the means by which the Platform is accessed, whether via desktop computers, mobile devices, or other interfaces. This Policy is intended to provide transparency regarding Chozi's information processing practices. It does not create additional contractual rights beyond those expressly established in Chozi's Terms of Service. This Policy should be read in conjunction with the Terms of Service, which govern use of the Platform. In the event of a conflict between this Policy and the Terms of Service, the Terms of Service shall prevail with respect to contractual obligations, limitations of liability, dispute resolution, and enforcement. By accessing or using the Platform, you acknowledge that you have read and understood this Policy. If you do not agree with this Policy, you should not access or use the Platform.
Section 2. Corporate Structure and Data Processing Roles
Chozi operates through affiliated legal entities for the purposes of ownership, development, operation, and administration of the Platform. Chozi S.A. is the entity that owns the Platform and acts as the primary data controller for information collected and processed in connection with use of the Platform. Chozi S.A. determines the purposes and means of information processing in accordance with this Policy and applicable law. Chozi North America and other current or future affiliated entities may process information on behalf of Chozi S.A. in their capacity as processors, service providers, or agents. These functions may include, without limitation, customer support, user onboarding, technical operations, analytics, billing support, communications, marketing operations, and administrative services. Such affiliated entities process information solely in accordance with the instructions of Chozi S.A. and do not act as independent data controllers, unless expressly stated otherwise. You acknowledge and agree that information collected through the Platform may be accessed, stored, or processed by Chozi affiliated entities or by third-party service providers acting on Chozi's behalf, subject to contractual, technical, and organizational safeguards designed to protect such information. These arrangements do not alter Chozi's role as a technology platform or the distribution of responsibilities established in the Terms of Service. Nothing in this Policy shall be construed as creating a partnership, joint venture, fiduciary, or agency relationship between you and any Chozi entity, beyond the data processing roles described in this Policy.
Section 3. Information We Collect
Chozi collects information in connection with your access to and use of the Platform through various means, including information you provide directly, information generated from your interaction with the Platform, and information collected automatically through technical means. The categories of information collected are limited to what is reasonably necessary to operate, maintain, improve, and develop the Platform, enforce the Terms of Service, and serve legitimate business purposes. Information You Provide Directly When you create an account, use the Platform, or communicate with other users or with Chozi, you may provide information including, without limitation, your name, email address, phone number, profile information, login credentials, and other identification or contact data. If you register or manage an account on behalf of a company, agency, or organization, you may also provide organizational information, role data, and related metadata. You may voluntarily provide content such as property listings, photographs, videos, descriptions, documents, messages, and other materials. You acknowledge that any information or content you choose to submit through the Platform is provided at your own discretion and responsibility, in accordance with the Terms of Service. Information Generated by Platform Use Chozi collects information generated from your use of the Platform, including interactions with listings, searches, filters, saves, likes, views, inquiries, messages, scheduling activities, and other interaction signals. This information may be associated with your account and used to enable features, generate metrics, performance indicators, and internal analytics, in accordance with the Terms of Service. Automatically Collected Information When you access the Platform, Chozi may automatically collect certain technical and usage information, including IP address, device identifiers, browser type, operating system, access times, referral URLs, log files, and similar technical data. Chozi may also use cookies, pixels, and comparable technologies to support authentication, security, analytics, and Platform functionality. You acknowledge that certain information may be collected automatically as a necessary part of providing the Platform, and that disabling certain technologies may limit your access or functionality.
Section 4. How We Use Information
Chozi uses the information it collects for legitimate business purposes consistent with the operation of a technology platform, the Terms of Service, and applicable law. Information is used to provide, maintain, and operate the Platform, including account creation, authentication, listing publication, communications, collaboration tools, and other core features. Information may be used to personalize and improve the user experience, develop and optimize features, troubleshoot technical issues, monitor performance, and ensure the security, integrity, and stability of the Platform. Chozi also uses information to conduct internal analysis, research, reporting, and testing in order to better understand Platform usage and continuously improve it. Chozi may use information to communicate with users regarding account activity, service updates, feature changes, administrative messages, support requests, and other operational or transactional communications. Information may also be used to enforce the Terms of Service, detect and prevent fraud, abuse, or violations, and comply with legal, regulatory, or contractual obligations. Information collected through the Platform is not used to provide legal, financial, real estate, or professional advice, to make decisions on behalf of users, or to participate in transactions between users.
Section 5. Aggregated, Anonymized, and Derived Data
Chozi may aggregate, anonymize, de-identify, or derive data from information collected through the Platform in a manner that does not identify you or any individual user. This aggregated or anonymized data may be generated from usage patterns, interactions, performance metrics, listing activity, communication metadata, and other Platform signals. Aggregated and anonymized data may be used by Chozi for various lawful commercial purposes, including analytics, benchmarking, research, market intelligence, reporting, product development, operational planning, and commercial purposes, including potential monetization. You acknowledge and agree that aggregated and anonymized data does not constitute personal data and that you have no proprietary rights, claims, or interests in such data or in the analyses, metrics, or derivative products generated from it. Nothing in this Section limits Chozi's right to use Platform data in accordance with the Terms of Service, this Policy, and applicable law, or restricts Chozi's ability to improve, commercialize, or evolve the Platform using data that does not identify individuals.
Section 6. Cookies and Similar Technologies
Chozi uses cookies and similar technologies, including pixels, local storage, and other identifiers, to operate and support the functioning of the Platform. These technologies are used to enable essential features such as authentication, account access, security, session management, and feature performance. Chozi may also use cookies and similar technologies to collect analytical and usage information, understand how users interact with the Platform, monitor performance, diagnose technical issues, and improve functionality and the user experience. Some cookies may be set directly by Chozi, while others may be set by third-party service providers acting on Chozi's behalf for analytics, infrastructure, or security purposes. You may control or manage the use of cookies through your browser or device settings. However, disabling or restricting cookies may limit your ability to access certain Platform features. By continuing to use the Platform without modifying your settings, you consent to the use of cookies and similar technologies as described in this Section, to the extent permitted by applicable law.
Section 7. How We Share Information
Chozi may share information collected through the Platform in limited circumstances and in accordance with the Terms of Service, this Policy, and applicable law. Information is shared only to the extent necessary to operate, maintain, improve, protect, and develop the Platform and Chozi's business. Information may be shared with Chozi affiliated entities, including Chozi North America, when such entities act as processors, agents, or service providers on behalf of Chozi S.A. These entities may access information for purposes such as customer support, technical operations, analytics, billing support, communications, marketing operations, and administrative services, and only to the extent necessary to fulfill those functions. Chozi may also share information with service providers and third parties that provide services on Chozi's behalf, including hosting and infrastructure providers, analytics services, communication tools, security services, payment processors, and professional advisors such as legal, accounting, or compliance firms. Such providers are authorized to access information only to the extent necessary to provide services to Chozi and are subject to contractual obligations designed to protect that information. Information may be disclosed when necessary to comply with applicable laws, regulations, legal processes, governmental requests, or court orders, or when Chozi reasonably believes that such disclosure is necessary to protect the rights, property, security, or integrity of Chozi, its users, or the Platform, to investigate or prevent fraud, abuse, or security incidents, or to enforce the Terms of Service. In the event of a merger, acquisition, corporate restructuring, financing, or sale of all or part of Chozi's assets, information may be transferred as part of that transaction, subject to appropriate confidentiality protections. Chozi does not sell personally identifiable information as a consumer data broker. Any sharing of information is conducted in accordance with this Policy and applicable law.
Section 8. Data Retention
Chozi retains information collected through the Platform for as long as reasonably necessary to operate, maintain, and improve the Platform, provide services to users, enforce the Terms of Service, comply with legal and regulatory obligations, resolve disputes, and protect Chozi's legitimate business interests. Retention periods may vary depending on the type of information, the purpose for which it was collected, and applicable legal, accounting, or compliance requirements. Certain information may be retained after the deactivation, suspension, or cancellation of an account when necessary to comply with legal obligations, maintain records, prevent fraud or abuse, enforce agreements, or resolve disputes. Chozi may retain aggregated or anonymized data indefinitely, as such data does not identify individual users and is used for analytics, research, reporting, and commercial purposes in accordance with the Terms of Service and this Policy.
Section 9. Information Security
Chozi implements reasonable administrative, technical, and organizational measures designed to protect information against unauthorized access, loss, misuse, alteration, or destruction. Such measures may include access controls, encryption, monitoring, internal policies, and security procedures appropriate to the nature of the information processed and the associated risks. You acknowledge and agree that no system, network, or method of data transmission or storage is completely secure. While Chozi takes reasonable steps to protect information, Chozi does not guarantee absolute security and will not be liable for unauthorized access, security breaches, or incidents outside its reasonable control. You are responsible for taking appropriate steps to protect your own information, including safeguarding your login credentials, using secure devices and networks, and promptly notifying Chozi of any actual or suspected security incident related to your account.
Section 10. User Responsibilities and Information You Share
You are responsible for the information and content you choose to provide, upload, publish, or share through the Platform, including any personal data of yourself or third parties. You represent and warrant that you have all rights, authorizations, and legal bases necessary to share such information and that its disclosure does not violate any law, regulation, or third-party rights. Chozi is not responsible for information you voluntarily disclose to other users through the Platform, including through messages, listings, comments, or other interactions. Any information shared with other users is provided at your own risk, and Chozi has no control over how other users may use, store, or disclose such information. You agree not to transmit sensitive personal information through the Platform except where strictly necessary and appropriate for your intended use. Chozi disclaims all responsibility for the protection or misuse of information you choose to disclose to other users outside of Chozi's direct control.
Section 11. International Data Transfers
Chozi operates as a globally accessible platform and may process, store, and transfer information across multiple jurisdictions. Accordingly, information collected through the Platform may be transferred to, stored in, or accessed from countries other than the country in which you reside or from which you access the Platform, including jurisdictions that may have different data protection laws. By accessing or using the Platform, you acknowledge and consent to the transfer of your information to the countries in which Chozi, its affiliated entities, or its service providers operate, to the extent permitted by applicable law. Chozi takes reasonable steps to ensure that such transfers are made with appropriate safeguards, in accordance with this Policy and applicable legal requirements.
Section 12. Your Rights and Choices
Depending on your jurisdiction, you may have certain rights with respect to your personal information, such as the right to request access to, correction of, or deletion of information Chozi holds about you. You may also have the right to object to or restrict certain processing of your information, or to withdraw your consent where processing is based on consent. Chozi will evaluate and respond to requests in accordance with applicable law and may require verification of your identity before responding to any request. You acknowledge that certain requests may be limited, deferred, or denied where permitted by law, including where fulfilling them would interfere with legal obligations, dispute resolution, security, fraud prevention, record-keeping, or Chozi's legitimate business interests. You may update certain account information directly through the Platform. Requests related to data rights may be submitted using the contact information provided in this Policy. Chozi does not guarantee that all requests can be fulfilled in all cases.
Section 13. Third-Party Services and Links
The Platform may contain links, integrations, or references to third-party websites, applications, tools, services, or resources that are not owned, operated, or controlled by Chozi. Such third-party services may include, without limitation, map services, analytics tools, payment processors, communication platforms, or external websites linked from listings or user profiles. Chozi is not responsible for the privacy practices, data handling, content, availability, security, or operation of third-party services. Your interaction with any third-party service is governed solely by the terms, policies, and practices of those third parties, and you acknowledge that Chozi has no control over and assumes no responsibility for the actions or omissions of such third parties. We recommend reviewing the privacy policies and terms of service of any third-party service you choose to use in connection with the Platform. Chozi disclaims all liability for any losses, damages, or claims arising from your use of or reliance on third-party services.
Section 14. Privacy of Minors
The Platform is not intended for use by persons under the age of eighteen (18) or the age of legal majority in their jurisdiction, whichever is greater. Chozi does not knowingly collect, use, or solicit personal information from minors. If Chozi becomes aware that personal information has been collected from a minor without the required legal consent, Chozi reserves the right to take appropriate steps to delete such information and cancel the associated account. Parents or legal guardians who believe that a minor has provided personal information through the Platform may contact Chozi using the contact information provided in this Policy.
Section 15. Changes to This Policy
Chozi reserves the right to modify, update, or revise this Policy at any time, at its sole discretion. Any changes will take effect upon publication on the Platform or at a later date indicated by Chozi. Chozi may, but is not obligated to, notify users of material changes through the Platform, email, or other reasonable means. You acknowledge and agree that it is your responsibility to review this Policy periodically to stay informed of any updates or changes. Your continued access to or use of the Platform after the effective date of a modified Policy constitutes your acknowledgment of the update and your acceptance of the information processing practices described. If you do not agree with any modification to this Policy, you should discontinue use of the Platform.
